1. Acceptance of Terms
By accessing or using BhaiZap, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use BhaiZap.
2. WhatsApp & Meta Compliance
You must comply with all applicable Meta and WhatsApp rules when using BhaiZap to send or manage WhatsApp messages. This includes policies Meta may update from time to time.
- Adherence to policies: You must comply with the WhatsApp Business Messaging Policy, the WhatsApp Commerce Policy where applicable, Meta Platform Terms and Developer Policies, and Meta's requirements for WhatsApp Business Platform and technical providers, as they apply to your use of our service.
- Opt-in requirement: You are strictly prohibited from sending unsolicited messages. You must obtain clear, verifiable consent (opt-in) from end users before messaging them on WhatsApp, in line with WhatsApp and applicable law. You are responsible for maintaining evidence of consent and honoring opt-outs promptly.
- Prohibited content: You may not use BhaiZap to distribute illegal content or content that violates Meta's Community Standards or WhatsApp's policies, including harmful, deceptive, or abusive material as defined by those policies.
3. Account Responsibilities
- Accuracy: You must provide accurate business and account information and keep it current, including information required for Meta Business Verification or WhatsApp onboarding.
- Security: You are responsible for safeguarding your account credentials, API keys, and any devices used to access BhaiZap. Notify us promptly if you suspect unauthorized access.
4. Fees and Payments
- Billing: Fees for BhaiZap (including subscription, usage-based, or other charges) are as described in your order, agreement, checkout flow, or the pricing information we provide at signup or on our website. You agree to pay all amounts when due.
- WhatsApp charges: Meta may impose conversation-based or other WhatsApp-related fees. Unless we expressly state otherwise in writing, those Meta/WhatsApp fees are your responsibility. We may pass them through on your invoice, charge them via your connected billing method, or include them in your plan—whichever we disclose when you subscribe or use the relevant feature.
5. Termination of Use
We may suspend or terminate your access to BhaiZap if you violate these Terms, our Privacy Policy, or Meta/WhatsApp policies, or if necessary to protect the security or integrity of the service, other customers, or our status as a provider on Meta's platforms. You may stop using BhaiZap at any time; provisions that by their nature should survive (including disclaimers and limitations of liability) will survive termination.
6. Limitation of Liability & Disclaimers
- "As-is" service: BhaiZap is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
- Liability cap: To the fullest extent permitted by law, our total aggregate liability arising out of or relating to BhaiZap or these Terms will not exceed the greater of (a) the fees you paid to us for BhaiZap in the twelve (12) months before the claim arose, or (b) one hundred U.S. dollars (USD $100) if you have not paid fees in that period. This limitation applies whether the claim is in contract, tort, or otherwise, even if we have been advised of the possibility of such damages.
Some jurisdictions do not allow certain disclaimers or liability limits; in those jurisdictions, our liability is limited to the maximum extent permitted by law.
